TERMS AND CONDITIONS including refunds & returns
These terms and conditions (the “Terms and Conditions”) govern the use of www.gymnasticsfoundations.com (the “Site). This Site is owned and operated by Adventures and Awards Ltd, which also owns the Trademark of The Hub Gymnastics Foundations. This Site is an ecommerce website.
By using this Site, you indicate that you have read and understand these Terms and Conditions and agree to abide by them at all times.
Intellectual Property
All content published and made available on our Site is the property of Adventures and Awards Ltd and the Site’s owners. This includes, but is not limited to images, videos, animation, text, logos, documents, downloadable files and anything that contributes to the composition of our Site. Trademark and Copyrights apply.
Sale of Goods
These Terms and Conditions govern the sale of goods available on our Site.
The following goods are available on our Site:
- Medals (physical goods, non printables)
- Certificates (physical goods, printables)
- Posters (physical goods, printables)
- Stickers (physical goods, non printables)
- Digital downloads of our A4 tick-sheets
- Digital downloads of our songs
- Hubert the Gymast Bear toy
We are under a legal duty to supply goods that match the description of the good(s) you order on our Site.
These Terms and Conditions apply to all the goods that are displayed on our Site at the time you access it. This includes all products listed as being out of stock. All information, descriptions, or images that we provide about our goods are as accurate as possible. However, we are not legally bound by such information, descriptions, or images as we cannot guarantee the accuracy of all goods we provide. You agree to purchase goods from our Site at your own risk.
We reserve the right to modify, reject or cancel your order whenever it becomes necessary. If we cancel your order and have already processed your payment, we will give you a refund equal to the amount you paid. You agree that it is your responsibility to monitor your payment instrument to verify receipt of any refund.
Payments
We accept the following payment methods on our Site:
- PayPal
When you provide us with your payment information, you authorise our use of and access to the payment instrument. By providing us with your payment information, you authorise us to charge the amount due to this payment instrument.
If we believe your payment has violated any law or these Terms and Conditions, we reserve the right to cancel or reverse your transaction.
Shipping and Delivery
When you purchase goods from our Site, the goods will be delivered through one of the following methods.
- Royal Mail
- Digital Download
Delivery will take place as soon as reasonably possible, depending on the delivery method and availability of stock. Delivery times may vary due to unforeseen circumstances. Please note that delivery times (Royal Mail) do not include weekends and bank holidays.
You will be required to provide us with a complete and accurate delivery address, including the name of the recipient. We are not liable for the delivery of your goods to the wrong address or wrong person as a result of you providing us with inaccurate or incomplete information.
Right to Cancel and Receive Reimbursement
Physical goods, non printables – 14 days
If you are a customer living in the United Kingdom or the European Union you have the right to cancel your contract to purchase physical goods, non printables, from us within 14 days. The cancellation period will end 14 days from when you receive, or someone receives for you, the physical goods.
Physical goods, printables – 1 hour
If you are a customer living in the United Kingdom or the European Union you have the right to cancel your printables that are printed especially for your order, “Custom printed”, within 1 hour of the order being placed. Cancellations after 1 hour will not be accepted, when you buy printables from www.gymnasticsfoundations.com, you agree to these terms.
To exercise your right to cancel, you must inform us of your decision to cancel by emailing hello@gymnasticsfoundations.com with your order number, order date, customer name, customer address, item to return and reason, within the cancellation period stated above.
The right to cancel does not apply to:
- Printables that have been printed one hour after placing your order; “Custom printed”.
- Digital downloads, including PDFs, resource material, online content and music. You waive the right to cancellation as soon as the download starts. As it is instant, it is deemed “used” and no longer eligible for cancellation, refunds or exchanges.
Effects of Cancellation for physical goods, non printables
If you cancel your contract with us and physical goods, non printables, have already been sent to you, then you must return the goods to us within 14 days of informing us of your decision to cancel. You will be responsible for the cost of returning the goods. We will not be responsible for any damage or loss to the goods that occurs before they are returned to us, including while the goods are in transit. Once we have received the physical goods, non printables, in a new and unused condition, with original packaging, with no damage or loss, we will reimburse to you the payments we received from you under the contract, minus the delivery charge. Please note that we are permitted by law to reduce your reimbursement to reflect any reduction in the value of the goods that was caused by handling other than what is necessary to establish the nature, characteristics and functioning of the goods. You are responsible for the goods while they are in your possession.
We will make the reimbursement using the same form of payment as you used for the initial purchase.
Refunds for physical goods, non printables
If any of the goods are faulty, a refund request must be made within 14 days after receipt of your goods and the goods returned to us within 14 days after informing us via hello@gynmnasticsfoundations. Once we have received the faulty item and we deem the item to be faulty, we will send you a replacement free of charge.
Refunds do not apply to printables if not cancelled within an hour of placing the order nor do they apply to any digital download.
Exchanges for physical goods, non printables
If you would like to exchange any physical goods, non printables, please email hello@gymnasticsfoundations.com and we will do our best to get your exchanged items to you. Please be aware that you are responsible for the cost of sending the unwanted item back to us and also delivery costs to send out to you the exchanged item.
Returns
Returns can be made by Royal Mail.
Limitation of Liability
Adventures and Awards Ltd and our Directors and employees will not be liable for any actions, claims, losses, damages, liabilities and expenses including legal fees from your use of the Site.
Applicable Law
These Terms and Conditions are governed by the laws of the Country of England.
Disclaimer
By using our products, posters and videos, you understand that all forms of physical activity can carry the risk of injury. It is the responsibility of the adult conducting these activities to ensure that it is the appropriate level for the participants involved and where necessary hold relevant coaching qualifications.
It may be necessary to adapt certain skills should equipment not be available or provide physical adjustments to ensure maximum safety for the participants.
QR Codes which link to demonstration videos on the Skill Specific Awards / drill sheets will be valid for a minimum of two years. We are constantly looking to improve our material so if we feel an updated video would be beneficial, we will notify our existing clients to the latest versions.
